The fine print, kept short.

01The agreement

These terms are an agreement between you and PushPact (“we”, “us”). By downloading or using the app you accept them. If you don’t, please don’t use the app.

The app is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms supplement it; if they conflict, the Standard EULA applies. Our Privacy Policy explains how we handle data.

02Exercise risk

• Not medical advice. PushPact is not a medical device and does not diagnose, treat or prevent any condition.
• Consult a doctor before starting any exercise programme, especially if you have a medical condition or injury, are pregnant, or haven’t exercised in a while.
• Stop immediately if you feel pain, dizziness, faintness, chest discomfort or shortness of breath, and get medical help if needed.
• You choose your goal. Pick one that suits your fitness, exercise on a safe, stable surface, and place your phone where it won’t fall or get in the way.

You take part voluntarily and assume the risks of exercising. We don’t guarantee any fitness or health results.

03Rep counting

Counting is automatic and can be wrong. Rep counts, streaks, seals and medals are for motivation only and have no monetary value.

04App Lock and Screen Time

App Lock depends on Apple’s Screen Time, which we don’t control. It may fail, be delayed, be bypassed, or change with iOS updates. You can turn it off at any time. To the extent the law allows, we are not liable for missed content, messages or notifications, or for any app being locked or unlocked when you did or didn’t expect it.

05Emergencies

Phone calls and emergency services are never blocked by PushPact. Don’t rely on PushPact in an emergency, and don’t lock apps you may need urgently.

06Your content

Your selfies, films and cards are yours and stay on your device. If you share them, you’re responsible for what you share, including where other people appear in them.

07Price and paid features

PushPact is free to download from the App Store. If we offer paid features, they are sold through the App Store and billing is handled by Apple, including renewals, cancellations and refunds, under Apple’s terms. The price is shown before you buy.

08Acceptable use

You agree not to:

• copy, modify, reverse engineer or redistribute the app, except where the law allows;
• interfere with the app or our services, or try to access them in unauthorised ways;
• send false, abusive or automated data to our services;
• use the app unlawfully or to harm anyone.

09Our rights

The app, its content, the PushPact name and Pip the seal belong to us or our licensors. Apart from the licence to use the app, these terms give you no rights in them.

10No warranties

To the extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don’t promise the app will be uninterrupted, error-free or always available.

11Limitation of liability

To the extent permitted by law:

• we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill;
• our total liability for all claims relating to the app is limited to the greater of the amount you paid for the app in the 12 months before the claim, or USD 50.

Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

12Indemnity

To the extent permitted by law, you agree to indemnify PushPact against claims, losses and reasonable costs arising from your misuse of the app or your breach of these terms.

13Apple and the App Store

• These terms are between you and PushPact only, not Apple. Apple is not responsible for the app or its content.
• Your licence is limited to using the app on Apple devices you own or control, as allowed by the App Store Usage Rules.
• PushPact, not Apple, is responsible for any maintenance and support.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the app.
• PushPact, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, privacy, and intellectual property claims.
• You confirm that you are not in a country subject to a US Government embargo or designated as supporting terrorism, and are not on any US Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms, such as your mobile data agreement.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14Termination

You can stop using the app at any time by deleting it. We may suspend or end your use of our services if you break these terms. Sections that by their nature should survive, including exercise risk, no warranties, limitation of liability and indemnity, continue after termination.

15Changes

We may change the app or these terms. We’ll update the date above and tell you in the app about material changes. Continuing to use the app after a change means you accept it.

16Governing law

These terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules, and the competent courts in Tel Aviv, Israel have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in your local courts where those laws allow it.

17General

• Severability: if any part of these terms is unenforceable, the rest stays in effect.
• Entire agreement: these terms, the Standard EULA and our Privacy Policy are the entire agreement between you and us about the app.
• No waiver: not enforcing a term doesn’t waive our right to enforce it later.
